On February 7th, 2019, Michelle Morris was at her usual tasks performing measurements to prepare and install window treatments at a customer’s Mount Holly law firm. Ms. Morris ran a successful interior design company.
She was about to step into an office to be measured, and the glare on the hardwood floor made it difficult to discern that the office was situated several feet lower than the entryway, and she missed the step, injuring her ankle. The fall at issue, in this case, caused her to aggravate a previous ATFL tear, and the patient underwent surgery on June 13, 2019. She later sustained a postoperative infection and required additional irrigation and debridement. She also underwent a course of IV antibiotics for the infection.
After retaining Michael A Galpern of the Javerbaum Wurgaft firm, the suit was filed on Ms. Morris’ and her husband’s behalf, against the owner of the property.
Mr. Galpern, a partner at Javerbaum Wurgaft and a certified civil trial attorney, retained a professional engineer, two podiatric experts, and one orthopedic expert.
After 2 years of discovery, the case was mediated on 6-27-22 before the Honorable Eugene McCaffrey JSC (Ret) and after a full day of mediation, settled for $450,000.
