After an eight-day trial in Essex County Superior Court, Javerbaum Wurgaft Partner, Samuel J. Perez, won a $2.5M trial verdict for our client who was operating his vehicle, with his wife in the passenger seat, on the New Jersey Parkway northbound in the afternoon of August 29, 2016. He exited at exit 145, a two-lane exit. He was proceeding in the left-hand lane of the two lanes when Defendant, cut across the painted area separating Parkway north traffic and the exit lanes. Our client saw the defendant’s vehicle cutting in front of him at the last second. In an effort to avoid the defendant’s vehicle, our client turned his car to the left which resulted in the passenger side front of our client’s vehicle hitting the driver’s side rear of the defendant’s vehicle.
The defendant denied this version of events and claimed that he was in the right-hand lane of the parkway approximately a quarter mile before exit 145 when our client struck the rear of his vehicle.
Our client treated with a chiropractor and orthopedic doctor for a little over a year. He suffered a bulging disc in his cervical spine, three bulging discs in his lumbar spine, and meniscal tears in both of his knees. For his injuries he underwent two lumbar epidural injections and cortisone shots in both of his knees.
